1. Overview

This Shipping & Returns Policy applies to all works purchased from Windsor Betts Art Brokerage (operated by Miratio LLC, "Windsor Betts," "we," "us"). It explains how we handle shipping, packing, insurance, damage in transit and the limited circumstances in which a refund may be issued.

This policy forms part of our Terms of Service.

 

2. How we ship

We tailor shipping arrangements to each work’s size and value as well as the destination.

•  For larger or more valuable works being shipped within the United States, we work with established professional art handlers experienced in the safe handling of fine art. The specific handler is selected for each shipment based on the route and the requirements of the work.

•  For smaller or lower-value works, we partner with a local packing and shipping specialist who selects the most efficient and cost-effective carrier for each piece. In most cases this means UPS or FedEx. For some shipments a freight service such as DHL may be used.

•  For some smaller or lower-value works, we pack and ship in-house using USPS or FedEx. UPS is also used when appropriate.

•  For local deliveries within the Santa Fe area, we may offer in-house white-glove delivery as a value-added service.

In every case, packaging is selected and executed to industry standards for the type of work being shipped.

 

3. International shipping

Windsor Betts ships internationally on a case-by-case basis. International shipments are arranged through a third-party international art shipper experienced in customs documentation and the export-import requirements that apply to each route. International shipping is not a standard offering on the Site, and we ask collectors interested in shipping outside the United States to contact us directly so we can assess the shipment and provide a quote.

 

For international shipments, the buyer is responsible for any customs duties, import taxes and other fees imposed by the destination country.

 

4. Shipping cost

Unless otherwise agreed, shipping is quoted separately from the sale price of the work and added to the invoice. We work to provide a shipping quote so that the total cost is clear, though various factors (typically dictated by the collector’s actions) can affect this. Where a collector prefers to arrange shipping independently, we are happy to release the work to a shipper of the collector’s choice once payment has cleared and at the collector’s sole risk from that point forward.

 

5. Insurance in transit

Shipping insurance is typically included in the quoted shipping cost and covers the work for its full sale value while in transit. For shipments where insurance materially affects the total shipping cost, we are happy to discuss the options with the collector before the shipment is finalized. In all cases, the gallery’s objective is that the work arrives safely and in the same condition in which it left the gallery.

 

6. Damage in transit

On rare occasions a work may be damaged during shipping despite professional packing and insured carriage. If you receive a work that appears to be damaged, please follow these steps:

•  Do not discard any of the packaging. The packaging is required by the carrier as part of the claims process.

•  Photograph the packaging and the damaged work from multiple angles, including close-ups of the affected area.

•  Contact us at info@windsorbetts.com or 505.820.1234 within 48 hours of delivery, attaching the photographs.

 

Once notified, we will work with you to handle the carrier claim and a suitable resolution. Depending on the nature of the damage, this may include repair by a qualified conservator at the gallery’s cost, replacement (where possible) or refund of the purchase price.

 

7. Returns

Each work we offer is unique, has been reviewed by our specialists and is presented to collectors with detailed information. Because of the nature of the works we handle, we do not accept returns for change of mind or for reasons unrelated to authenticity or transit damage.

 

8. Authentication and refund

We stand behind our attributions. Every work we sell has been reviewed in person by our specialists, drawing on decades of direct familiarity with the artists and artworks we handle, and where appropriate we consult with additional experts and recognized authorities.

 

In the unlikely event that a work purchased from Windsor Betts is conclusively shown to be inauthentic, we will refund the purchase price under the following conditions:

•  The claim is made in writing within twelve (12) months of the original sale date.

•  The work is returned to Windsor Betts in the same condition as when it was sold.

•  A reasoned authentication finding from a recognized authority on the artist (such as the artist’s estate, a published catalogue raisonné author or a comparable scholar) is provided in support of the claim.

 

Upon verification, Windsor Betts will refund the original purchase price. Shipping and any restoration costs incurred by the collector during the period of ownership are not refundable.

 

9. Title and risk of loss

Title to the work passes to the buyer upon receipt of full payment in cleared funds. Risk of loss passes to the buyer upon delivery to the buyer or buyer’s address, except where the buyer has elected to use a shipper of their own choosing, in which case risk of loss passes upon release of the work to that shipper at the gallery.

 

10. Changes to this policy

We may update this Shipping & Returns Policy from time to time. The terms in effect at the time of a sale will apply to that sale.
